Vendor Terms of Service Print On Demand Marketplace
These Vendor Terms of Service ("Vendor Terms") govern participation as a seller or vendor on Print On Demand Marketplace. By applying for, registering for, maintaining, or using a vendor account, you agree to these Vendor Terms and all other applicable marketplace policies.
These Vendor Terms should be read together with our Conditions of Use, Privacy Policy, Vendor Pricing & Fees Policy, Vendor Shipping & Fulfillment Policy, Vendor Payout Policy, AI & Intellectual Property Policy, and any other policies published by Print On Demand Marketplace.
1. Vendor Eligibility
Vendors must provide accurate and current business, contact, tax, payout, and account information when requested.
Print On Demand Marketplace reserves the right to approve, decline, restrict, suspend, or terminate vendor applications or accounts when reasonably necessary to protect customers, other sellers, the marketplace, or applicable legal requirements.
2. Independent Seller Relationship
Vendors operate as independent businesses. Nothing in these Vendor Terms creates an employment relationship, partnership, franchise, joint venture, or agency relationship between a vendor and Print On Demand Marketplace.
Unless Print On Demand Marketplace is specifically identified as the seller of a product, the applicable vendor remains responsible for the products offered through that vendor account.
3. Products That May Be Sold
Qualifying products may include print-on-demand apparel, drinkware, home and living products, accessories, wall art, prints, stickers, decals, personalized products, custom merchandise, gifts, and other approved products.
Print On Demand Marketplace may restrict or prohibit products that are illegal, infringing, unsafe, deceptive, inappropriate for the marketplace, or otherwise inconsistent with marketplace policies.
4. Product Listings
Vendors are responsible for ensuring that all product listings are accurate, complete, and not misleading.
Listings should accurately describe applicable:
- Product names
- Materials
- Sizes
- Colors
- Product options
- Personalization requirements
- Pricing
- Production times
- Shipping information
- Fulfillment information
- Product images and mockups
Vendors must promptly correct listings that become inaccurate or outdated.
5. Product Images & Mockups
Product images and mockups must reasonably represent the merchandise a customer can expect to receive.
Minor differences may occur because of printing methods, product materials, manufacturing tolerances, color reproduction, display settings, and fulfillment-provider variations.
Vendors may not intentionally use misleading mockups or images that materially misrepresent the final product.
6. Marketplace Fees
Print On Demand Marketplace currently uses a simple marketplace fee structure described on the Vendor Pricing & Fees page.
The current standard marketplace fee is 10% on qualifying completed sales, with payment processing included in that marketplace fee unless otherwise disclosed.
There is currently no standard monthly subscription fee, listing fee, or vendor setup fee unless a separate optional service or future plan specifically states otherwise.
Fees may be updated in the future. Material changes will be communicated through the website, vendor dashboard, email, or other reasonable means.
7. Vendor Pricing
Vendors are generally responsible for setting their own product prices.
Vendors should price products sufficiently to cover their own production costs, fulfillment expenses, shipping obligations, marketplace fees, taxes, refunds, and other business expenses.
8. Payment Processing
Customer payments may be processed through payment providers selected by Print On Demand Marketplace.
Vendors authorize Print On Demand Marketplace and its payment providers to collect customer payments associated with marketplace orders and deduct applicable marketplace fees, refunds, chargebacks, adjustments, or other authorized amounts before vendor proceeds are distributed.
9. Vendor Payouts
Eligible vendor proceeds will be distributed according to the current Vendor Payout Policy and supported payout methods.
Vendors are responsible for maintaining accurate payout information.
Payouts may be delayed, adjusted, or temporarily withheld when reasonably necessary to investigate refunds, chargebacks, suspected fraud, account verification, fulfillment problems, customer disputes, or marketplace-policy violations.
10. Fulfillment Providers
Vendors may use qualifying print-on-demand companies, production partners, and fulfillment providers of their choice, subject to marketplace requirements.
The vendor remains responsible for the performance of the vendor's selected fulfillment provider.
Using a third-party fulfillment provider does not transfer the vendor's obligations to customers or Print On Demand Marketplace.
11. Production Times
Vendors must provide reasonable production and handling estimates for their products.
Production time is separate from shipping transit time. Vendors should update estimates when production or fulfillment conditions materially change.
12. Shipping
Shipping rates and delivery estimates may be based on the vendor's fulfillment provider, product type, destination, production location, and available carrier services.
Vendors are responsible for maintaining accurate shipping information when shipping rules are controlled by the vendor.
Vendors may not intentionally inflate shipping charges in a deceptive manner or use shipping charges to disguise undisclosed product costs or marketplace fees.
13. Tracking Information
Tracking information should be provided when available after an order has been fulfilled and shipped.
False, recycled, misleading, or knowingly inaccurate tracking information is prohibited.
14. Fulfillment Errors
Vendors are responsible for working with their fulfillment providers when merchandise is damaged, defective, misprinted, incorrectly produced, lost, or otherwise affected by a fulfillment-related issue.
Repeated fulfillment problems may result in listing restrictions, account review, suspension, or termination.
15. Returns & Refunds
Vendors must comply with applicable Print On Demand Marketplace return and refund policies.
Because many print-on-demand products are made after an order is placed, personalized and made-to-order products may have different return eligibility than ordinary retail merchandise.
Customers may still be entitled to an appropriate resolution when products arrive damaged, defective, misprinted, incorrect, or materially different from the listing.
16. Customer-Supplied Personalization
Vendors offering personalized products should clearly explain customization requirements.
Customers are generally responsible for reviewing names, dates, text, images, colors, sizes, and other personalization information before submitting an order.
Vendors should make reasonable efforts to fulfill personalization exactly as submitted by the customer.
17. AI-Generated & AI-Assisted Designs
Print On Demand Marketplace permits AI-generated and AI-assisted designs, subject to the AI & Intellectual Property Policy.
Vendors using artificial intelligence tools are responsible for ensuring that they have sufficient commercial rights to use the resulting content.
The use of AI does not remove or reduce the vendor's responsibility for copyright, trademark, publicity-right, or other intellectual-property compliance.
18. Copyrights, Trademarks & Intellectual Property
Vendors must own or have sufficient legal rights to use all artwork, designs, photographs, logos, trademarks, text, graphics, and other content submitted to the marketplace.
Unauthorized use of copyrighted artwork, company logos, entertainment characters, sports-team marks, celebrity images, protected brand names, or other third-party intellectual property is prohibited.
Print On Demand Marketplace may remove or disable listings that appear to violate intellectual-property rights or marketplace policies.
19. Publicity & Personality Rights
Vendors are responsible for ensuring that the use of a person's name, image, likeness, voice, photograph, or other identifiable characteristics complies with applicable laws and permissions.
20. Counterfeit & Misleading Products
Counterfeit merchandise is prohibited.
Vendors may not falsely claim that a product is officially licensed, authorized, endorsed, handmade, hand-drawn, branded, or affiliated with another person or organization when that claim is not true.
21. Customer Information
Customer information provided to vendors may only be used for legitimate purposes associated with marketplace orders, fulfillment, shipping, customer service, refunds, and related transactions.
Vendors may not sell, rent, disclose, misuse, harvest, or independently market to customers using information obtained through Print On Demand Marketplace except where expressly permitted by law and marketplace policy.
22. Customer Service
Vendors must communicate with customers professionally and respond to reasonable order-related questions and concerns within a reasonable period.
Harassment, threats, abusive conduct, discrimination, or intentionally misleading communication is prohibited.
23. Reviews & Marketplace Manipulation
Vendors may not manipulate reviews, ratings, transactions, search placement, customer accounts, or marketplace activity through deceptive or fraudulent methods.
Creating fake purchases, fake reviews, or fraudulent customer accounts is prohibited.
24. Taxes
Vendors are responsible for understanding and complying with tax obligations applicable to their businesses.
Where required by law, Print On Demand Marketplace or its payment providers may collect and remit sales tax, marketplace-facilitator tax, or similar taxes.
Vendors remain responsible for taxes that are not collected or remitted by the marketplace.
25. Vendor Content License
By submitting product images, designs, logos, descriptions, videos, mockups, specifications, or other content, the vendor grants Print On Demand Marketplace a non-exclusive license to display, reproduce, resize, format, distribute, advertise, and promote that content for purposes associated with operating and marketing the marketplace and the vendor's products.
Ownership of vendor content remains with the vendor or applicable rights holder.
26. Prohibited Conduct
Vendors may not:
- Commit fraud or intentionally deceive customers
- Sell illegal or prohibited products
- Sell counterfeit merchandise
- Misrepresent products or fulfillment information
- Misuse customer information
- Upload malicious software or harmful links
- Manipulate marketplace reviews or transactions
- Interfere with marketplace systems
- Engage in repeated intellectual-property violations
- Use the marketplace for unlawful activity
27. Vendor Account Suspension
Print On Demand Marketplace may restrict or suspend vendor accounts when reasonably necessary to investigate suspected fraud, customer complaints, intellectual-property violations, fulfillment failures, chargebacks, policy violations, or other marketplace risks.
28. Vendor Account Termination
Vendor accounts may be terminated for serious or repeated policy violations, illegal activity, fraud, counterfeit products, repeated infringement, abuse of customers, excessive fulfillment failures, or conduct that threatens marketplace integrity.
Account termination does not eliminate outstanding customer, refund, payment, tax, or legal obligations.
29. Marketplace Availability
Print On Demand Marketplace does not guarantee uninterrupted website availability, a specific amount of traffic, sales volume, product exposure, search placement, or vendor revenue.
Marketplace functionality may occasionally be unavailable because of maintenance, technical issues, third-party service interruptions, security events, or other circumstances.
30. Changes to Marketplace Services
Print On Demand Marketplace may modify marketplace features, categories, policies, seller tools, payment options, or other services as the marketplace develops.
31. Limitation of Liability
To the fullest extent permitted by applicable law, Print On Demand Marketplace shall not be responsible for indirect, incidental, special, consequential, or punitive damages arising from a vendor's participation in or use of the marketplace.
32. Indemnification
To the extent permitted by law, vendors agree to indemnify and hold harmless Print On Demand Marketplace and its owners, employees, contractors, and service providers from claims, losses, damages, liabilities, or expenses arising from the vendor's products, designs, listings, conduct, intellectual-property violations, legal violations, fulfillment activity, or breach of these Vendor Terms.
33. Changes to These Vendor Terms
These Vendor Terms may be updated periodically to reflect marketplace changes, new services, legal requirements, or business practices.
Material changes may be communicated through the marketplace website, vendor dashboard, email, or another reasonable method.
Continued use of a vendor account after revised Vendor Terms become effective constitutes acceptance of those updated terms.
34. Governing Law
These Vendor Terms shall be governed by the laws of the State of Kansas, United States, except where applicable law requires otherwise.
